1. Acceptance
These Terms apply when you use payitforwardos.com or a Pay It Forward OS (“PIFOS”) workspace operated by FitchCraft (“we,” “us”). By using the service you agree to these Terms and to our Privacy Policy. If you are accepting on behalf of an organization, you confirm you are authorized to bind that organization.
2. Eligibility
You must be old enough to form a binding contract where you live, and you must be acting for yourself or for an organization you are authorized to represent. Workspaces are granted to organizations we review and approve; submitting a request is not approval.
3. The service
PIFOS gives an approved organization a branded public presence and a private operational workspace on shared infrastructure. Available features depend on the organization’s configuration and on the platform’s current state of readiness. We add, change, and remove features over time.
4. Accounts and your responsibilities
- Provide accurate information and keep it current.
- Keep your credentials confidential; you are responsible for activity under your account.
- Tell us promptly if you suspect unauthorized access.
- Administrators are responsible for who they invite, the roles they grant, and removing access when someone leaves.
5. Organization responsibilities
Each organization is responsible for the content it publishes, the accuracy of the records it maintains, the lawfulness of the information it collects, and any consents required from the people described in those records — including participants who are minors. You are responsible for your own regulatory, tax, and charitable-solicitation obligations. We provide software; we do not provide legal, tax, accounting, or fundraising-compliance advice.
6. Acceptable use
You agree not to:
- Attempt to access another organization’s private records, or to bypass, probe, or defeat authentication, permissions, or tenant isolation.
- Access any account, data, or system area you are not authorized to reach.
- Upload malware, or content that is unlawful, infringing, harassing, deceptive, or that you lack the right to share.
- Use the service to defraud anyone or to solicit funds deceptively.
- Interfere with the service — including automated scraping, excessive load, or attempts to disrupt availability for others.
- Reverse engineer, resell, or sublicense the platform, except where the law says you may.
Good-faith security research is welcome. Report findings to hello@payitforwardos.com rather than disclosing them publicly, and do not access, alter, or retain data that is not yours.
7. Your content and the license we need
You and your organization keep ownership of the content and records you put into PIFOS. To run the service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, copy, transmit, display, back up, and process that content — only as needed to operate, secure, support, and improve the service for you, and to publish the parts you choose to make public. This license ends when the content is deleted, except for copies retained in routine backups or as required by law. See Data Ownership.
8. Our intellectual property
The PIFOS platform, software, design, and brand are owned by FitchCraft and its licensors. These Terms do not transfer any ownership in the platform to you. Your organization’s own name, logo, and marks remain yours.
9. Fees — what $0 actually means
For approved organizations, the base PIFOS platform fee is $0 under the current Pay-It-Forward model: no monthly PIFOS subscription and no required contract term for the donated base workspace. See the $0 Platform Promise.
Costs that are not PIFOS platform fees may still apply — third-party payment processing, messaging or SMS services, custom domain registration, and optional outside services. If an optional paid FitchCraft service is ever offered beyond the donated base platform, it will be clearly separated and disclosed before any charge.
10. Donations and payments
On-site card processing is not currently enabled. Organizations may link to their own external giving page; those pages are operated by that provider and that organization, not by us, and their terms apply.
If and when on-site processing is activated, payments are handled by our payment processor under its own terms, PIFOS takes 0% of charitable donations, and funds are designed to flow to the participating organization. Standard third-party processing costs may still apply. Receipting, refunds, donor acknowledgements, and the tax treatment of any gift are the responsibility of the receiving organization.
11. Third-party services
PIFOS relies on third-party infrastructure and integrations — hosting, database and authentication, file storage, payment processing, email delivery, an AI assistant provider, browser push services, and embedded media platforms. Their availability and their terms are outside our control, and we are not responsible for third-party services or the content they deliver.
12. Availability — no uptime guarantee
The service is provided on an as-available basis. We do not offer a service-level agreement or an uptime guarantee, and we may modify, suspend, or discontinue features, or perform maintenance, at any time. We will make reasonable efforts to give notice of significant planned changes.
13. Suspension and termination
You may stop using PIFOS at any time and ask us to close your workspace. We may suspend or terminate access — with notice where practical, and immediately where necessary — for violation of these Terms, for risk to the platform or other organizations, or if we discontinue the service. On termination you may request a copy of your organization’s records as described in Data Ownership.
14. Disclaimers
To the fullest extent permitted by law, the service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory — including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that data will always be available or accurate. Marketing copy is not a contractual guarantee.
15. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost donations, lost goodwill, or lost or corrupted data, arising out of or relating to your use of the service — even if we were advised such damages were possible.
Because the base platform is provided at no charge, our total aggregate liability for all claims relating to the service is limited to the greater of the amounts you actually paid us for the service in the twelve months before the claim, or one hundred U.S. dollars ($100.00). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
16. Indemnification
You agree to indemnify and hold harmless FitchCraft and its personnel from claims, damages, and reasonable costs arising from your content, your use of the service, your violation of these Terms, or your violation of the rights of another — including claims relating to information about people that your organization entered into its workspace.
17. Governing law
These Terms are governed by applicable law, and any dispute will be resolved in a court of competent jurisdiction. A specific governing law and venue will be designated in a revised version of these Terms; until then, nothing in this section waives any right you have under the law that applies to you.
18. Changes to these Terms
We may update these Terms as the service develops. We will change the effective date above and, for material changes, make a reasonable effort to notify organization administrators. Continuing to use the service after a change means you accept the updated Terms.
